What is an SMSF loan?
A SMSF is able to borrow money to purchase investments. An SMSF loan is when money is borrowed by a Self Managed Super Fund and its trustees, from a third party lender, and is used to purchase an investment — often property — with the goal to increase the SMSF members' retirement savings.
How does an SMSF loan work?
When an investment property is purchased with an SMSF loan, the property is held in trust for the SMSF until the loan is repaid. This is called a Limited Recourse Borrowing Arrangement (LRBA) and exists to protect the other assets held by the SMSF in the event that the loan is defaulted on. If the loan is unable to be repaid, the lender can legally take only the property held in trust.
Can you refinance a SMSF loan?
Yes. Just like a regular home loan, refinancing is an option. However, there are strict SMSF loan refinancing regulations set out by the ATO that need to be adhered to in order to remain compliant. It is not possible to increase the loan amount — you are simply replacing the original loan. While repairs to the property are appropriate uses of the loan, you are unable to ‘improve’ an asset, so refinancing with the goal to renovate isn’t allowed.
Can I occupy the property?
SMSFs are generally not allowed to lease property to a related party, which means you are unable to live in a residential property that has been purchased for an SMSF. Doing so would breach the “in-house asset rule” and could have severe consequences for the fund. However, if you have a business, a commercial property can be leased to the related business by the SMSF.
